In Minnesota, DUI and DWI are basically the same thing in practice. DUI or “Driving Under the Influence” is a more common term nationwide. Minnesota’s DWI statute is “driving while impaired” (DWI), covering driving/operating/physical control of a motor vehicle while impaired by alcohol, controlled substances, cannabis/THC, intoxicating substances, and also certain BAC thresholds (e.g., 0.08+ for noncommercial and 0.04+ for commercial), plus refusal to submit to chemical tests.
Does it matter if your charges say DWI or DUI? No because the terms DWI and DUI refer to the same charge in Minnesota.
