Second Degree Controlled Substance Sale 10 grams or more within a 90 day period and Fourth Degree Possession of 10 or more dosage units of Phencyclidine (mushrooms) while possessing a firearm, Minn. Stat. 152.022, 609.11.  The drug task force also seized a large amount of cash found in the vehicle. Client was facing mandatory 48 months in prison. 
Outcome:  Second Degree Controlled Substance sale while possessing a firearm charge dismissed and a large amount of cash seized during the arrest was returned to the Defendant.

Charges: Felony Domestic Assault-By Strangulation. Jury Trial
Outcome: After a week-long jury trial including testimony of eight witnesses for the State, Mr. Grostyan gave a closing argument that convinced the jury to find his client NOT GUILTY of Felony Domestic Assault by Strangulation.

Court: Anoka County
Charges: Felony Terroristic Threats; Felony Domestic Assault-By Strangulation; Domestic Assault.
Outcome: Prosecutor offered a plea to Felony and several years in prison. Mr. Grostyan attacked the truthfulness of the alleged victim’s statements. Both Felony charges were dismissed. Client pled to misdemeanor causing fear of domestic assault with no prison or jail time.

Court:  St. Louis County 
Charges:  FelonyPossession andSale of Methamphetamine – First Degree 
Outcome:  Client was facing mandatory 130 months in prison.  Mr. Grostyan prepared motions to suppress evidence from trial which resulted in an agreement with the St. Louis County Attorney to dismiss the First Degree Controlled Substance charges and plead to a lesser charge without any prison or jail time.

Charges:  Theft of Identity, Credit Card Fraud, Theft of Property
Outcome:  Client was facing a presumptive commit to prison for 70-80 months.  Mr. Grostyan was able to obtain a dispositional departure for his client which meant no prison and not one day in jail.

Court: Federal Court 
Charges: Conspiracy to distribute over 500 grams or more of cocaine
Outcome: Client was facing a 34 year federal prison sentence.  Attorney Grostyan successfully argued for a departure from the U.S. Attorney’s recommendation from 34 years to 9 years.

Charges: First Degree Controlled Substance Possession-30 lbs of marijuana
Outcome: Mr. Grostyan challenged the forensic evidence in the case and the charges were dismissed.

Charges: Felony Robbery
Outcome: Mr. Grostyan brought motions to include the alleged victim’s criminal history. State agreed to dismiss felony charge in exchange for plea to a lesser misdemeanor offense.

Charges: 3rd Degree DWI; Open Bottle; Possession of Drug Paraphernalia
Outcome: Mr. Grostyan filed a motion to dismiss the charges based on an illegal stop.  The judge granted the motion and the charges were dismissed.

Outcome:
 Charges dismissed at trial.

Outcome: Mr. Grostyan negotiated a dismissal of the Third Degree DWI Test Refusal charge with a plea to a misdemeanor DWI charge, no jail.

Charges: Misdemeanor 4th Degree DWI Minn. Stat. § 169A.20 subd. 1 (1) and (5).
Outcome: DWI charges dismissed. Pled guilty to careless driving.

Outcome: Mr. Grostyan challenged whether his client was in physical control of the vehicle, when the client was in the driver’s seat, the engine was not running and the police, despite alleging they saw keys in the client’s hand, could not locate the keys to the vehicle. The prosecutor agreed to dismiss the DWI charges.

Charges: Felony Drug Possession
Outcome: Client was caught with over three pounds of marijuana. Mr. Grostyan negotiated an agreement where the case would be dismissed in six months.

Court: Wright County
Charges: Felony Fleeing a Peace Officer in a Motor Vehicle, Fourth Degree DWI
Outcome: Evidence included a squad car video showing client’s vehicle driving at a high rate of speed during police pursuit. Mr. Grostyan negotiated an agreement where the Felony would be dismissed.

Court: Washington County
Charges: Theft
Outcome: Mr. Grostyan convinced the judge to grant an expungement of his client’s record.

Court: Ramsey County
Charges: Fourth Degree 
Outcome: Mr. Grostyan challenged the legality of the vehicle stop and all charges were dismissed.

Charges: DWI
Outcome: Mr. Grostyan argued that the police needed a warrant for a breath test and the DWI charges were dismissed and the license revocation was rescinded from client’s driving record.

Court: Dakota County
Charges: Domestic Assault Attempt to Inflict Bodily Harm; Minn. Stat. 609.2242 subd. 1 (2).
Outcome: The prosecutor dismissed all charges and the judge terminated the no-contact order. Mr. Grostyan was also successful in getting the judge to remove or expunge these charges from his client’s record.

Charges: 4th Degree DWI
Outcome: Mr. Grostyan challenged the admissibility of the urine test. The prosecutor dismissed all charges.

Court: Anoka County
Charges: Gross Misdemeanor Second Degree DWI; Gross Misdemeanor Driving After Cancellation-Inimical to Public Safety.
Outcome: Defendant was facing a mandatory 90 days jail and the police seized his vehicle. Mr. Grostyan was able to get the charges dismissed and the client also got his car back.

Charges: DWI Vehicle Seizure
Outcome: Mr. Grostyan was able to negotiate an agreement for the vehicle to be returned to the Defendant.

Court: Hennepin County
Charges: Disorderly Conduct, Obstruction of Legal Process.
Outcome: Mr. Grostyan was able to successfully negotiate a resolution whereby the court entered a stay of adjudication and avoided any criminal conviction.

Court: Olmsted County
Charges: Gross Misdemeanor Second Degree DWI and Vehicle Seizure.
Outcome: Mr. Grostyan was able to successfully negotiate a resolution whereby the client pled guilty to a lesser DWI charge and the remaining charges, including the charge that supported the vehicle seizure, were dismissed.

Outcome: Dismissed.

Charges: Misdemeanor Fourth Degree DWI
Outcome: Mr. Grostyan was able to successfully negotiate a resolution whereby the client pled guilty to careless driving and avoided a DWI conviction. This was an extraordinary outcome in light of the fact that the client’s breath test was .18.

Outcome: Mr. Grostyan was able to successfully negotiate a resolution whereby the client pled guilty to Minor Consumption and the remaining charges were dismissed. As a result of this plea agreement, the client avoided a driver’s license revocation.

Charges: Probation violation of a Gross Misdemeanor DWI
Outcome: Probation officer asked judge to impose 180 days of jail for client’s failure to stay in contact with probation for three years and failure to follow any recommendations of probation. Mr. Grostyan convinced the judge to take his client off probation without any jail or penalties.

Charges: Speeding 105 mph; Window Tint Violation
Outcome:  Attorney Anthony Grostyan argued that the window tint statute was unconstitutionally vague and the state could not prove the speeding charge. Defendant was acquitted of both charges.

Outcome: Charge dismissed.

Charges: Felony Fleeing a Peace Officer; Felony DWI Refusal
Outcome: Felony Fleeing a Peace Officer charge was dismissed. Despite facing a mandatory prison commitment, the client pled guilty to a DWI charge with no jail, probation only.

Charges: 4th Degree DWI
Outcome: Mr. Grostyan was able to successfully challenge the urine test results, and the Court Attorney agreed to dismiss the DUI charge. Client, D.R., pled to careless driving.

Outcome: Mr. Grostyan filed a motion to suppress evidence. Prior to the hearing, the County Attorney agreed to dismiss all charges against M.H.M.

Outcome: Mr. Grostyan brought motions to challenge the stop of Defendant’s vehicle. After negotiations with the prosecutor, the parties agreed that all charges would be dismissed, and the client would plead to 3rd Degree DWI with no jail. Mr. Grostyan also negotiated a deal whereby the seized vehicle was returned to the client.

Outcome: After contested hearing, Judge granted Mr. Grostyan’s motion to rescind license revocation on grounds that Petitioner’s right to counsel was violated. State dismissed related criminal charges for same reason prior to hearing.
