The DWI Process

Getting charged with DWI can be a frightening experience, especially if you have never been arrested before and don’t understand the process. First a person is pulled over and given a breath test or a field sobriety test to determine if they may be driving under the influence. If the person’s blood alcohol is above .08%, they will be put under arrest, taken to the police station, and given further blood tests to confirm the original BAC. After release, they must then request a DMV hearing within 30 days of having their license taken away, in order to preserve the right to drive before the trial. If they lose the hearing, the revocation will remain on their license. After this hearing, there are other steps that will be taken:
- First hearing (also known as arraignment) where person is asked to enter a plea of guilty or not guilty
- If pled not guilty, then go to pre-trial conference to update judge and schedule trial
- Pre-trial motions and cross-examination of police officers involved in arrest
- Trial (where all evidence is heard before a judge and jury)
- If found guilty, go to sentencing hearing and find out what punishments will be applied
