The state of Minnesota has taken a very strong stance in regards to people found driving under the influence of alcohol. People convicted of a DWI, especially if it is not their first DWI offense, can face serious penalties such as jail time, fines, driver license revocation and more. In some cases, the state even has the right to seize and forfeit (keep and/or sell) the vehicle involved. Vehicle forfeiture can occur under the following circumstances:

  • It is the fourth offense and the driver is now charged with felony DWI
  • Is it the third offense within 10 years and the driver is now charged with DWI or test refusal
  • The driver is charged with any form of DWI or test refusal while driving with a cancelled license
  • The driver has a B-card designation (no alcohol use restriction), and tests positive for any amount of alcohol consumed prior to driving
  • It is the second offense within 10 years and the driver is now charged with DWI with a child under 16 in the car, test refusal, or tested with an alcohol level of .20% or more
